Stop Online Piracy Act

I've been reading this on a few posts and frankly it worries me.


I came into fandom three years ago at a time when I sorely needed something to save my sanity. At the time I was unemployed and losing hope. I began writing my first ever fanfiction (although I'd been creating stories in my head for some time) and posted my first story on another site, before eventually being led to LJ.

I don't know about anyone else, but this saved my life. I now have more than 100 stories (epics and one shots) and I really don't know what I would have done without those stories. I'm a creative person and this has been my outlet. My stress levels would probably have gone through the roof if I hadn't had this.

I now have friends in at least four or five other countries which I never would have had, having never really been out of New Zealand, apart from Australia. Four of the people on my flist I count as my very dear friends, no, make that best friends.

Long story short, I worry what this Bill, if passed, will do to fandoms. As I'm sure everyone else is. I've read enough to think there are some producers of certain shows who aren't particularly worried about people writing fanfiction. Yes, it could be seen to be a breach of copyright, but none of us are making any profit from it. And in my case, it has helped me hone my writing skills enough that I am almost confident enough to consider sending my original works away to publishers. Almost.

But from my perspective, I hate to say this, there is a good chance the Bill will pass. I'm not sure if other countries have already done so, but New Zealand is one of the ones leading the charge.

If you can't (it may not be available via the US) the gist of it is that anyone caught file-sharing will be warned three times. If they continue, their internet service will be suspended for a period of six months.

What their definition of file-sharing is, I'm not one hundred percent certain. 

While I can see their point on some things, there are some grey areas I would like to point out:

1. We can buy tv episodes, movies, songs online. What happens if we download those, for our own personal use? Are we in breach of copyright then? 

2. What happens if the fandom is of a tv series like Smallville which has officially ended? If we're not profiting from it, is it legally theft? The characters may be theirs, but the ideas in the stories are ours.

3. It would be like someone writing an essay for a university paper and borrowing quotes from a particular text. As long as we don't claim those words as ours and source the quotes correctly, is that breach of copyright? Yes, some of us borrow from scripts, but only to fit around the stories we write.

It remains to be seen if this will truly affect fandom in terms of fanfiction. If this Bill does pass, they will need to have very clear definition of what constitutes a breach.

I hope this does not go through. It's sad that are goverment is doing this and our rights are slowly disappearing. And i have a bad feeling it's only going to get worse. People need to stand up and take action before we have no rights.

I haven't studied the US Constitution but I thought the original intention of the constitution and the amendments were to guarantee freedom of expression. There should be some concessions surely.

Yes we are suppose to have freedom of speech. We still do but things are slowly changing.

Honestly, I hate to see people's freedoms being compromised due to the actions of a few. I'm beginning to think certain conspiracy theorists might be on to something.

I agree. things are not like they use too. I was believing australia was the best country now I don't know. There has been alot of talk for years about the New World Order. Lets just hope this won't be for a long long time. I would not want to live in a world like that.
